Article 44 of the Indian Constitution | Uniform Civil Code |                        AJAY SHARMA LAW

Article 44 is part of the Directive Principles of State Policy (Part IV). (DPSP) It means that the government should try to bring one common set of civil laws for all citizens of India, irrespective of religion, in matters like:
  • Marriage

  • Divorce

  • Maintenance

  • Adoption

  • Inheritance

  • Succession

 Nature of Article 44

  • It is not enforceable by courts (Article 37).

  • It is a directive to the State for future legislation.

  • Aims at national integration and equality.

 Objective of Article 44

  • To promote equality before law (Article 14).

  • To remove discrimination based on religion in personal laws.

  • To ensure gender justice, especially for women.

  • To strengthen secularism.

LANDMARK CASE LAWS

  1. Mohd. Ahmed Khan v. Shah Bano Begum (1985)
    Supreme Court emphasized the need for a Uniform Civil Code.

  2. Sarla Mudgal v. Union of India (1995)
    The Court strongly urged the State to implement Article 4

Family Court section 7  (Its Jurisdiction) (1) A Family Court has the same power as a District Court or a lower Civil Court in family-related matters. It means that, following all the other rules of this law, a Family Court must: (a) Have and use all the powers that a District Court or any lower Civil Court has, according to the laws in effect right now.
